BW Confidential Terms & Conditions

1. General Provisions

These are the terms and conditions for which you may use the BW Confidential Magazine and the BW Confidential website and the content/services available on it. These terms apply to your use of BW Confidential both irrespective of the delivery platform you use - e.g. desktop PC, laptop, mobile device or otherwise - and irrespective of how the BW Confidential Content is delivered to you - e.g. via web browser, mobile internet browser, email or otherwise.

These terms may be changed from time to time. Your access to the site will be deemed to constitute acceptance of these terms. Should you consider these rules, terms and conditions or any future changes, unacceptable to you, you may stop using the service and cancel your subscription by contacting us at contact@bwconfidential.com.

BW Confidential shall have the right at any time, in its sole discretion, to make modifications, additions or deletions to the content and the terms on this page. Any changes to our terms will be published on the site. By continuing to access the site following a change to the terms, you agree to be bound by any changes.

2. Access and Use

BW Confidential operates “PAID FOR” subscriptions to the BW Confidential Magazine and bwconfidential.com. By subscribing to these services you agree to all the terms and conditions set out in this document. Each subscription offer is defined in detail and includes: service paid for, period of subscription and price including tax. In the case of promotional offers the following information will also be given: period of validity of the special offer and parties for whom the offer is exclusively reserved.

3. Registration

All information received by you from your use of BW Confidential is in accordance with our Privacy Policy. On subscribing, you must provide BW Confidential with accurate, complete registration information, and you are responsible for updating and maintaining changes to that information on the BW Confidential registration pages.

Each subscription is for a single user only. You will have a LOGIN and PASSWORD to access BW Confidential Content. Your LOGIN is your email address. For increased security, you must provide a password with at least six characters, which, along with your LOGIN, gives you access to BW Confidential Content. Different cases can however, apply:
- You forget your password. Request a new password by providing BW Confidential with your email login. You will receive a new password by email, which you are free to change.
- You forget your login. Email subscribe@bwconfidential.com with your contact information (company, name, postal address, telephone number and email).
- You want to change your password. Email subscribe@bwconfidential.com with your contact information (company, name, postal address, telephone number, email and password) or go to the account settings on bwconfidential.com and change your password.

BW Confidential does not permit any other person to share your LOGIN or PASSWORD or access through a single LOGIN or PASSWORD made available to multiple users on a network or within an organization. BW Confidential may cancel or suspend your access to BW Confidential if you do so without further obligation to you.

You are responsible for all use of the BW Confidential Magazine and website made by you or anyone else using your LOGIN and PASSWORD and for preventing unauthorized use of your LOGIN and PASSWORD. If you believe there has been any breach of security such as the disclosure, theft or unauthorized use of your LOGIN or PASSWORD or any payment information, you must notify BW Confidential immediately by emailing contact@bwconfidential.com.

4. Rates

You agree to pay any subscription fees at the rates in effect when the charges are incurred. Any subsequent modification of the subscription rates has no effect on the subscription in progress. The subscription prices are indicated inclusive of all taxes unless otherwise indicated. You must provide us with complete and accurate payment information.

The subscription price is set out on the pages which contain our subscription information. You can take out an annual subscription, which will automatically renew or any other fixed term or automatically renewing payment frequency that we may offer from time to time. BW Confidential will notify you in advance of any price increases. If a free trial is made available to you, you will only be charged with effect from the expiry of that free trial period. No more than one free trial per subscriber is allowed. We reserve the right without notice and at any time to terminate any free trial. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your subscription.

Our offers of products and their prices are valid as long as they are visible on the website.

BW Confidential will process your subscription as promptly as possible, but does not guarantee that the subscription will be available to you by any specified time.

BW Confidential reserves the right to suspend or terminate your subscription if you breach these terms and conditions, with or without notice and without further obligation to you.

With the exception of any cancellation rights you have, BW Confidential does not provide refunds for the BW Confidential report once delivered.

5. Payment Options

BW Confidential subscribers can pay in either United States Dollars or Euros. BW Confidential offers several payment options for subscribers: electronic payment by credit card; bank transfer; payment upon reception of an invoice and check. By submitting credit-card payment details you warrant that you are entitled to purchase the subscription using those payment details. In the case of unauthorized payments BW Confidential reserves the right to suspend or terminate your access to BW Confidential Content. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to any BW Confidential Content.

In the case of payment by check, the check must be issued by a bank domiciled in France. All checks are deposited upon reception.

You are not permitted to deliberately attempt to access content without paying the subscription fee. Any attempt to do so is a breach of these terms and conditions and may also constitute an offence as a matter of law. BW Confidential fully reserves all rights it may have to enforce its rights under these terms and conditions or at law.

6. Cancellation

You may cancel or amend your subscription at any time by contacting our subscription department at subscribe@bwconfidential.com or by telephone at +33 (0) 1 75 51 08 99. For cancellations, BW Confidential will refund you on a pro-rata basis. This means that BW Confidential will refund you or credit your account with any amounts you have paid us in advance that relate to any remaining period of your subscription. Any cancellation will be effective once BW Confidential receives notice of it.

7. Security

Our website is protected by a security system. Any payment information you send to us over the Internet is encrypted using Secure Socket Layer (SSL) technology. SSL is currently the preferred method to securely transfer credit-card data over the Internet.

8. Warranties and Limitation of Liability

The BW Confidential Content is only for your general information and use and is not intended to address your particular requirements. In particular, the BW Confidential Content, including User Content and any other content provided by third parties and distributed by BW Confidential, does not constitute any form of advice, recommendation, representation, endorsement or arrangement by BW Confidential and is not intended to be and should not be relied upon by users in making any specific decisions. BW Confidential Content is provided “as is”, without any warranties of any kind. All arrangements made between you and any third party named on the site are at your sole risk and responsibility. The material, texts and editorial contents published on bwconfidential.com or in the BW Confidential Magazine does not necessarily represent the views or opinions of Noon Media, its managers, employees or agents.

Noon Media and the editorial team of BW Confidential have taken every effort to ensure that the information contained on this website and in the BW Confidential Magazine is correct. However, errors can occur and Noon Media and BW Confidential do not guarantee the accuracy, reliability, completeness, usefulness of the material, texts and editorial contents published on the website and in the Magazine, nor their suitability for any particular purpose.

Readers and users of BW Confidential bear the responsibility of assessing the value of the material, texts and editorial contents published on bwconfidential.com or in the BW Confidential Magazine before using it. Noon Media and BW Confidential reserve the right to add to, withdraw, change or correct any material contained in this website as and when it considers it appropriate and without notice.

9. Copyright, Trademarks and Intellectual Property

All BW Confidential Content belongs to Noon Media or its licensors. Noon Media or its licensors own all intellectual property rights (including copyright and database rights) of the BW Confidential Content and any selection or arrangement of the BW Confidential Content.

You may:

Retrieve and display BW Confidential Content on any compatible device; and
Print a single copy of the BW Confidential report or individual articles on paper (but not photocopy them); and
Store such articles in electronic form on disk or on a mobile device (but not on any server or other storage device connected to a network).

You may not use BW Confidential for any unlawful purpose. Except as expressly set out above, any copying, reproduction, publishing, broadcasting, transmission, modification, adaptation, storage, archiving and public display of BW Confidential Content in whole or in part is strictly prohibited. Without limitation, you may not do any of the following without prior written permission from BW Confidential (and neither may you allow a third party to do any of the same):

Redistribute any of the BW Confidential Content, (including by using it as part of any syndication); or
Remove the copyright or trademark notice from any copies of BW Confidential Content made under these terms and conditions; or
Create a database in electronic or structured manual form by systematically and/or regularly downloading, caching, printing and storing all or any of the BW Confidential Content.

All infractions of these stipulations constitute a violation of the laws and regulations on copyrights and can result in legal action.

Trademarks, brand names, products and company names, other than those belonging to Noon Media are cited on this website for informational purposes, and those that are supplied by sponsors, advertisers and any other authorized third parties are the property of their respective owners.

10. Personal Data and Privacy Policy

We are committed to safeguarding the privacy of our users while providing a personalized and valuable service. Our Privacy Policy explains the data processing practices of bwconfidential.com and the BW Confidential Magazine. We collect personally identifiable data from you through the use of enquiry and registration forms and the provision of your details to us either online or offline. We also collect information automatically about your visit to our site. 11. Responsibility

The products offered on the website are in compliance with current French laws and standards. Noon Media and BW Confidential cannot be held responsible in the case of failure to comply with legislation of the country where the product is delivered. It is your responsibility to verify with local authorities the possibilities for the importing and use of any products and services that you might wish to order. In case of manifest error between the characteristics of the product and its representation and/or the terms of sale, BW Confidential cannot be held responsible.

12. Third-Party Sites and Services

Bwconfidential.com may provide links to third-party websites. These links are included to ease the user’s path through the Internet. As Noon Media and BW Confidential have no control over those websites or resources, their inclusion cannot be construed as implying any endorsement or validation of their content, advertising, products or services.

Over time, hyperlinks may become outdated and cease to work, or they can direct users to a website our resource that has been changed by its owner. Noon Media and BW Confidential cannot accept any responsibility or liability for any damage or loss caused by or in connection with the contents or services available through third-party websites or resources.

13. Force Majeure

Noon Media and BW Confidential shall have no liability for an event of Force Majeure, i.e an event or set of circumstances that is or are outside the reasonable control of BW Confidential.

14. Jurisdiction

These terms and conditions are subject to French law. French courts have sole jurisdiction. In case of litigation the courts of Paris, France, have jurisdiction.
